1. Introduction

Welcome to HASA Customs Clearance Co. Ltd ("HASA"). HASA is a leading company in customs clearance, freight forwarding, and customs consultancy in Tanzania. We provide comprehensive logistics services, including road transport, railway, air cargo, sea freight, warehousing, clearing, and forwarding services. By using our services, you agree to comply with and be bound by the following terms and conditions.

2. Services Provided

HASA offers a range of logistics solutions, including but not limited to:

  • Air Freight: Including complete logistics programs for various types of cargo such as hazardous, livestock, fashion & luxury goods, auto and automotive parts, oil & gas, pharmaceuticals, and precious metals. [cite: 21]
  • Warehousing: Including short and long-term storage, cargo loading/unloading, labeling, packing, fumigation, pest control, crating, distribution, POD reporting, and 24/7 safety and security systems. [cite: 22]
  • Land Freight: Specializing in transportation across East, Central, and Southern Africa, including assembly, synchronous positioning of load units, LTL, FTL, bulk cargo transportation, customs clearance, escort service, special transportation of dangerous & perishable goods, household goods, personal effects, tracing & tracking, domestic trucking & distribution, customs bonded transportation, and various value-added services.   • Customs Clearance: Handling all customs logistics for imports, transit shipments, and export goods in Tanzanian ports and border points, dealing with government agencies, import/export clearance, customs evaluation, duty & tax assessment, goods classification, duty payments, consultancy, customs bonded, and transit customs handling. 3. Client Responsibilities

4. HASA's Responsibilities

  • Compliance: HASA will comply with all applicable laws and regulations in the provision of services. [cite: 38, 39, 40]
  • Communication: HASA will provide timely updates and accurate information regarding the status of shipments. [cite: 64]

5. Limitation of Liability

  • HASA shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the services.
  • HASA’s liability for any direct damages shall be limited to the fees paid by the client for the specific services in question.

6. Indemnification

The client agrees to indemnify and hold HASA harmless from any claims, losses, damages, liabilities, and expenses arising out of or in connection with the client's breach of these terms or use of the services.

7. Payment Terms

  • Payment for services is due in accordance with the agreed-upon terms in the service agreement or invoice.
  • HASA reserves the right to withhold services in the event of non-payment.

8. Changes to Terms

HASA reserves the right to modify or amend these terms of service at any time. Clients will be notified of any significant changes.

9. Governing Law

These terms of service shall be governed by and construed in accordance with the laws of Tanzania.

10. Dispute Resolution

Any disputes arising out of or in connection with these terms or the services shall be resolved through amicable negotiations. If negotiations fail, the parties may resort to legal proceedings in accordance with the laws of Tanzania.

12. Miscellaneous
